ROSE TOOK A TOUR WITH MR. MONTGOMERY OUR NEWS CITY MANAGER AND SHOW THEM SOME OF THE OPPORTUNITIES I SEE HERE IN DOWNTOWN AND DOWN THE BOULEVARD AS FAR AS RESPONSIBLE REDEVELOPMENT OF OUR COMMUNITY AND EXPECT MY CONCERNS ON HOW WE NEED TO INCLUDE HER CURRENT RESIDENCE, OUR WORKFORCE ARE SMALL BUSINESSES IN OUR GROWTH AND OUR EXPANSION AS A CITY.

WE ARE WORKING ON TYING CIVIL TO STRINGS AS FAR AS SOLIDIFYING OUR EVALUATIONS OF VACANT BUILDINGS AND VACANT LANDS.

SO WE CAN START MAKING BETTER PLANS AND BETTER MARKETING FOR SOME OF THE AREAS OF DOWNTOWN.

ALONG INDIO BOULEVARD AND ALONG 111.

RECENTLY TALKED TO A FEW PEOPLE IN REAL ESTATE.

TO LOOK AT HOW HOUSE PRICES ARE GOING AS MANY OF YOU KNOW WHAT LOCAL FAMILIES IN OUR LOCAL ROOF FORCES HAVE AN EXTREMELY DIFFICULT TIM FINDING HOMES IN INDIO.

THAT ARE AFFORDABLE TO OUR WORKFORCE.

THIS IS BEEN HAPPENING FOR SEVERAL REASONS.

RIGHT NOW THEY'RE GETTING A LOT OF CASH OFFICE FOR PEOPLE COMING FROM LOS ANGELES AND ORANGE COUNTY.

PEOPLE ARE WORKING REMOTELY OUR COMPANIES WILL RENT OUT THE SAME HOMES TO OUR

RESIDENTS OR HIGHER PRICES.

SOME OF THE STATE AGENTS NOW WON'T CONSIDER ANY OTHER FHA LOANS.

WHICH TAKES MANY OF OUR RESIDENTS OUT OF THE MARKET AS WELL.

PEOPLE ARE ALSO MAKING OFFERS WELL ABOVE THE MARKET PRICE AND THERE AREN'T MANY HOMES CURRENTLY ON THE MARKET.

ONE RESIDENT HEARD ABOUT WAS A 25-YEAR-OLD WITH A COUNTY JOB WHO SAVED OVER HUNDRED $50,000 TO BUY A HOME.

AND HE'S BEEN LOOKING FOR ABOUT 8 MONTHS AND HAS NOT BEEN ABLE TO BUY A HOME IN INDIO.

ANOTHER FAMILY WAS TO CONSTRUCTION WORKERS.

PARENTS WHO HAD TO MOVE TO THE SALTON SEA BECAUSE THEY CAN NO LONGER AFFORD THE HOUSING IN INDIO AND THAT WILL EXPOSE THEM TO ALL THE HEALTH HAZARDS WE KNOW TO BE PRESENT IN THAT AREA.

SO THERE IS A LONG LIST OF RESIDENTS WILL EVENTUALLY BE DISPLACED FROM OUR CITY IF WE DO NOT TAKE ACTION SOON.

AND, I KNOW WERE CURRENTLY WAITING ON HER HOUSING ELEMENT.

I THINK WE SHOULD TAKE ACTION SOONER THAN LATER.

ON THESE ISSUES.

I WOULD LIKE TO SEE IF OUR COUNCIL WILL CONSIDER AT LEAST IMPOSING AND INCLUDING HOUSING ORDINANCE FOR THE TIME BEING UNTIL WE COULD GET THE RESULTS FROM THE HOUSING ELEMENT.

SO I WOULD LIKE TO ASK OUR COUNSEL FOR THEIR SUPPORT IN BRINGING THAT BACK AS AN AGENDA ITEM.

I WOULD ALSO LIKE TO SEE US START THE PROCESS OF PUTTING SOME OF OUR CITY-OWNED LAND FOR BIDDING BY DEVELOPERS WHO HAVE TH CAPACITY TO OFFER OUR RESIDENTS HOMES THAT THEY CAN OWN AT OBTAINABLE PRICES.

I THINK WE ALL RECOGNIZE HOW MUCH LAND OWNERSHIP CAN CHANGE THE TRAJECTORY OF OUR WORKING-CLASS FAMILIES AND TO PREVENT THE DISPLACEMENT OF A WORKING CLASS FAMILIES.

ANOTHER SUBJECT I WOULD LIKE TO PROPOSE TO HER COUNSEL IS BEEN IN A STUDY SESSION SO WE CAN WORK ON AN ORDINANCE TO PROVIDE LICENSES FOR RETAIL SALES OF CANNABIS WITHIN THE CITY OF INDIO AND WE HAVE PLENTY OF MODELS TO FOLLOW HERE IN THE VALLEY.

WE CAN PROVIDE THE SERVICES SAFELY IN A WAY THAT PROVIDES A ROAD TO OWNERSHIP FOR LOCAL BUSINESSES.

WE CURRENTLY HAVE A LEAK RATE OF ABOUT 55 PERCENT IN THE CITY OF INDIA WHICH MEANS WE LOSE 55 PERCENT OF OUR POTENTIAL SALES TAX T OTHER CITIES AND THE SURROUNDING AREAS WHICH ADDS UP TO $1.5 MILLION.

BY CUTTING OUT ONE OF THE LEADING INDUSTRIES IN THE VALLEY WE'RE INCREASING THE LEAK RATE WHERE WE NOW HAVE ANYONE WHO WANTS TO CONSUME CANNABIS LEGALLY WILL HAVE TO LEAVE OUR CITY AND IS MORE LIKELY TO STOP BY RESTAURANTS AND SHOPS ELSEWHERE OUTSIDE OF OUR CITY.

WHICH DECREASES OUR SALES TAX REVENUES THROUGHOUT THE YEAR.

WOULD LIKE TO SEE IF HER COUNSEL WOULD SUPPORT CONTINUING OUR STUDY OF THE CANNABIS RETAIL LICENSES AND BRING THAT BACK FOR A STUDY SESSION.

THAT'S PART OF THE HOUSING ELEMENT DISCUSSION.

I THINK AT THIS POINT COUNCILMEMBER ORTIZ HANG IN THERE.

I THINK THE MAJORITY OF US WOULD LIKE TO SEE SOMETHING AFFORDABLE BUT WOULD LIKE TO WAIT FOR THE PROCESS OF THE HOUSING ELEMENT TO TAKE ITS PLACE RATHER THAN IMPOSING THESE ON OUR EXISTING DEVELOPMENT COMMUNITIES.

SO THAT'S THE FIRST ONE.

IF THE PLAN IS DISPLACEMENT OF THOUSANDS OF RESIDENTS, THEN LET'S SAY THAT, RIGHT?

I AM LOOKING TO BRING A BALANCE OF HOUSING TO OUR CITY.

I KNOW WE DO HAVE SOME CITY-OWNED LAND IN DOWNTOWN AND I'M LOOKING TO HAVE IT PREPARED TO BE GOING OUT FOR BIDS.

WHAT WE HAVE TO DO TO PREPARE THOSE LOTS OF LAND TO BE GOING OUT TO BIDS FOR BUILDING HOUSING THAT WILL GO TO HER RESIDENCE.

THE DRIVER AND THE ADJACENT PARKING WAS ATTEMPTING TO PARK A PARKING STALL.

SHE ACCELERATED CRASH INTO THE WALL OF THE BUILDING JUMPING THE CURB THAT BUILDING IS LEASED TO OF COURSE THE FEDERAL GOVERNMENT FOR THE SOCIAL SECURITY ADMINISTRATION ACTIVITIES.

THE OWNER OF THE ADJACENT PROPERTY IS PRO COMP INVESTMENTS INK.

THE DAMAGE THAT OCCURRED WAS TO THE EXTERIOR WALL OF THE BUILDING AND PORTIONS OF THE INTERIOR WALL AS WELL.

YOU WILL SEE THERE IS THE BUILDING AND A PATH OF DIRT AND THEN YOU WILL SEE THE CURB, THE RACE CURB AREA WHICH IS LANDSCAPED AREA ON THE OTHER SIDE OF PARKING STALLS.

WHERE THE CURB CUT IS FOR THE ENTRY INTO THE LANDSCAPED AREA RIGHT THERE.

THERE'S NOT A LOT OF ROOM FOR THE BORAT LAFOND FOLKS TO ESSENTIALLY ENTER ON THEIR OWN PROPERTY AND TO CONDUCT REPAIRS THAT ARE NECESSARY.

HERE, THERE ARE SOME STUDS THAT WILL NEED TO BE REPLACED AND AFTER THE PLYWOOD IS REPLACED IT CAN BE PLASTERED AND PAINTED.

THE CONTRACTOR HAS SAID IT'S NOT A VIABLE OPTION TO MOVE ALL OF THE DAMAGE STUCCO AND WOOD THROUGH THE INTERIOR BUILDING.

THEY NEED A TRUCK TO REMOVE ALL OF THE DAMAGE MATERIAL FROM THE PARKING LOT AS SEEN IN THIS PHOTO.

THERE IS A CURRENT DISPUTE STATED BY PRO COMP THAT THE SOCIAL SECURITY BUILDING ENCROACHES ON ITS PROPERTY AND IT ACTUALLY SITS ON PRO COLUMNS PROPERTY BUT, I GET THIS DISPUTE STATED IN THE REPORT AND THE ISSUES OF THE ENCROACHMENT IS NOW BEFORE THE COUNCIL.CITY FOR THE PROPERTY IS LOCATED THAT THEY ADOPTED RESOLUTION CONSENTING TO THIS ACQUISITION.

AND ESSENTIALLY WE ARE PROVIDING TURNING OVER OUR POWER TO THEM AND OUR AUTHORITY TO THEM TO CONDUCT THE REPAIRS.

THEN ON THE BOTTOM RIGHT CORNER IS THE INGRESS AND EGRESS AND STAGING AREA TO BE ABLE TO GET ONTO THE PROPERTY, THE PORTION OF THE PROPERTY THAT'S NECESSARY TO FIX THE BUILDING AND ALL OF THAT YOU WILL SEE IS JUST PARKING AREA THAT EXISTS RIGHT NOW.

THE WORK CANNOT BE DONE SAFELY WITHOUT ENTRY.

BORRA-LAFIND CANNOT COMPLETE THE WORK WITHOUT ACCESS TO THE PROPERTY AND THERE'S NO SAFE WAY TO CONDUCT THE REPAIR WORK.

THE PROPERTY WITHOUT REPAIR ADVERSELY AFFECTS THE SURROUNDING COMMUNITY.

THE SECOND FINDING IS THAT THE QUASI-PUBLIC ENTITY AND THAT IS FOR BORRA-LAFOND WILL USE THE RIGHT OF ENTRY THAT WILL PROVIDE THE LEAST DAMAGE THE LEAST INCONVENIENCE OR LESS ANNOYANCE AND ITS CONSISTENT WITH THE SATISFACTORY COMPLETION OF THE REPAIRS.

IT'S VERY, IT'S NOT GOING TO BE AN INCONVENIENCE WITH RESPECT TO USING THE EXISTING PARKING LOT.

IT'S IN THE BACK OF THE BUILDING.

THE SCOPE OF THE WORK IS VERY CONSISTENT WITH COMPLETING THOSE REPAIRS.

LAST IS THE HARDSHIP TO THE QUASIPUBLIC ENTITY WHERE BORRA-LAFOND OUTWEIGHS ANY HARDSHIP TO THE SUBJECT PROPERTY.

HERE THERE'S A HOLE IN EXTERIOR.

THERE IS DAMAGE OF THE INTERIOR.

THIS BUILDING ACTIVELY IS AN ACTIVE BUILDING, HOUSES NECESSARY PUBLIC SERVICE AND THIS OUTWEIGHS THE MINIMAL IMPACT PRO COLUMNS PROPERTY.

ONCE THE CITY COUNCIL ADOPTS THE RESOLUTION IT MUST DO SO BY A VOTE.

THEN WHAT HAPPENS? FIRST, THEY TAKE THAT RESOLUTION AND THEY CAN THEN COMMENCE EMINENT DOMAIN PROCEEDING IN COURT.

FOLLOWING ALL THE CRITERIA OF THE LAW TO SEEK THIS TEMPORARY RIGHT OF ACCESS.

THEY COULD NOT ANSWER THE PRO COLUMNS PROPERTY WITHOUT A COURT ORDER PERMITTING ENTRY.

OR THEY HAVE TO GET A JUDGMENT THAT WOULD BE ENTERED IN THEIR FAVOR.

THEY WOULD HAVE TO MAKE A DEPOSIT OF SECURITY IN THE AMOUNT ORDERED BY THE COURT AND THEY WOULD HAVE TO PAY THE SUBJECT PROPERTY OWNER FOR THE REASONABLE RENT FOR THE TEMPORARY RIGHT OF ENTRY.

WHEN IS THE CITY'S INVOLVEMENT OF THE PASSIVE RESOLUTION AFTER ITS ADOPTION.

THE CITY HAS NO INVOLVEMENT.

THE CITY WOULD NOT BE PART OF ANY PROCEEDINGS BY BORRA-LAFOND.

STATE LAW PROVIDES A CITY IS NOT LIABLE FOR ANY DAMAGES CAUSED BY THE ACQUISITION OF THE TEMPORARY RIGHT OF ENTRY.

BORRA-LAFOND IS REIMBURSING THE CITY'S COST WHICH HAS BEEN THE COST FOR THE EMINENT DOMAIN ATTORNEY IN MY OFFICE AND SOME COST FO MYSELF AND THEIR PARTIES SUBMITTED A $5000 DEPOSIT AS WELL AND RESOLUTION FOR ADOPTION WOULD REQUIRE A FORCE FOR VOTE.
