THERE ARE THREE PARCELS OF LAND PROPOSED FOR DEVELOPMENT.

SO AROUND THE PARTICULAR SITE WE HAVE ON THIS CHART YOU WILL SEE THAT WE HAVE NORTH, SOUTH, EAST AND WEST.

WE HAVE VARIETY GENERAL PLAN ZONING AN EXISTING USES AND I WILL LET YOU READ THEM.

JUST TO NOTE, WE HAVE COMPARABLE ZONING AND GENERAL PLAN DESIGNATIONS.

I WILL POINT OUT INTERSTATE 10 IS LOCATED TO THE IMMEDIATE AS ADJACENT RIGHT AWAY AND IN A STATE AND IS CONTROLLED BY CALTRANS.

IT IS COMPOSED OF SEVERAL COMPONENTS.

IT IS COMPOSED OF A CARWASH.

WHAT THAT BASICALLY MEANS IS IS NOT SUBSTANTIVE ENVIRONMENTAL REVIEW.

THIS PROJECT FALLS WITHIN THE CLASS AS AN INFILL PROJECT AND TYPICALLY WHEN WE ARE MAKING FINDINGS FOR EXEMPTION, YOU WILL SEE A TABOR TABLE THERE FOR THOSE OF THE FINDINGS BEEN INTIMATE IN THE STAFF REPORT.

AS I MENTIONED EARLIER, THE SITE IS LOCATED NORTH OF INTERSTATE 10 AT LOOK AT THAT THE INTERSECTION OF BARNER ROAD AND JEFFERSON WHICH ARE CONSIDERED ARTERIAL ROADWAYS IN THE CITY.

THE ZONING DISTRICT DESIGNATION IS COMMUNITY COMMERCIAL.

THE CURRENT ZONING DESIGNATION WHEN WE LOOK AT THE LAND USES WE LOOK AT THEM IN THE CONTEXT OF PERMITTED COMMIT ADDITIONAL OR PROHIBITED LAND USES.

THE PROPOSED LAND USES BE REPRESENTED IN THIS APPLICATION ARE CONSIDERED CONDITIONAL LAND USES PRETTY FALL UNDER MUNICIPAL CODE 159 222 POINT F AUTO RELATED USES INCLUDING BUT NOT LIMITED TO PREPARE GARAGES GAS LIGHTS, DRIVE-THROUGH RESTAURANTS, MARKETS OR PART CARWASH IS.

SINCE ALL THOSE ARE SPECIFIED, THERE'S A CONDITIONAL USE REQUIRES YOUR REVIEW AND CONSIDERATION THIS EVENING.

THE PROJECT IS REQUIRED TO GO THROUGH WHAT WE CALL DESIGN REVIEW.

THIS REQUIRES THERE BE ANALYSIS OF THE PROPOSED DESIGN.

IF YOU LOOK AT THE CONDITIONS OF APPROVAL, STAFF HAS MADE A DETERMINATION THAT THE REASONABLE AND APPROPRIATE TO THE PROPOSED PROJECT AND ITS ASSOCIATED IMPACTS.

SO WOULD NOT, STAFF IS RECOMMENDING THE PLANNING COMMISSION ADOPT RESOLUTION NUMBER 2006.

THIS WOULD APPROVE THE CONDITIONAL USE PERMIT AND MAKE A FINDING THAT THE PROJECT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

STAFF IS ALSO RECOMMENDING THE COMMISSIONS APPROVAL RESOLUTION 2007 AND THIS WOULD APPROVE CONDITIONALLY THE DESIGN REVIEW APPLICATION AND THE CONDITIONS OF APPROVAL REFERENCED EARLIER WILL BE FOUND SUBSTANTIVELY.

ALTHOUGH THERE ARE MORE GENERAL CONDITIONS OF APPROVAL THE RESOLUTION FOR THE CONDITIONAL USE PERMIT.

SO WITH THAT, STAFF IS HAPPY TO ANSWER ANY QUESTIONS.

WITH THE CAPITAL EXPENDITURE BUDGET APPROVED BY THE CITY IN MAY, A SIGNIFICANT PORTION OF THE BUDGET FOR ROAD TRAFFIC AND IMPROVEMENTS IN THE CITY ARE PAID WITH FUNDS GENERATED DIRECTLY FROM GAS SALES TAX REVENUES WHILE WE DON'T OWN ALL THE GAS STATIONS IN THE CITY, WE ARE PROUD TO DO OUR PART TO CONTRIBUTE TO THE BUDGET WITH THIS NEW DEVELOPMENT WE REALLY HOPE OUR PROJECT CONTINUES TO SPUR ADDITIONAL DEVELOPMENT IN THE NEARBY VACANT PARCELS AND FURTHER IMPROVE THE CITY OF FESTIVALS.

THEREFORE YOU REALLY HAVE NO BUSINESS IMPROVING THE DEVELOPMENT AND ESPECIALLY NEW DEVELOPMENTS THAT WILL IMPACT ONE WILL PEOPLE, LATINA PEOPLE, POOR PEOPLE IN THE CITY OF INDIO.

THERE IS LIABILITY IN THE FORM OF AN INJUNCTION STOPPING ALL CONSTRUCTION IN THE CITY OF INDIO, NOT JUST THIS PROJECT.

I WILL ALSO ADD TO MY COMMENT THAT ONE MILE SOUTH OF THIS PARCEL OF LAND THAT ALREADY EXISTS A GAS STATION, A RESTAURANT, A CARWASH.

THERE'S NO NEED FOR ANOTHER GAS STATION.

TWO MILES WEST OF THE PARCEL THERE EXISTS THREE GAS STATIONS, AMPLE RESTAURANTS, AMPLE BUSINESSES.

IS ALREADY WHAT IS PROPOSED HERE.

TO THE EAST END THERE ALREADY EXISTS ANOTHER CIRCLE K.

THIS IS A VERSE IN LETHBRIDGE INTO THE CITY OF INDIO.

IS THE ONLY BRIDGE WITHOUT CONGESTION ADDING THIS PARTICULAR BUSINESS WILL NOT ONLY BECAUSE IDLING FURTHER, IT WILL CAUSE AIR POLLUTION I PERSONALLY BELIEVE THIS PROJECT WOULD HAVE RESULTED IN SIGNIFICANT EFFECTS TO TRAFFIC, NOISE, AIR AND WATER QUALITY.

THERE ARE CASES IN THE STATE OF CALIFORNIA THAT HAVE GONE IN 2016 FOR $140,000 SETTLEMENT BECAUSE OF ENVIRONMENTAL RACISM CREDIBILITY BY APPROVING THIS PROJECT YOU ARE HARMING THE LATINO POOR RESIDENTS OF THE CITY OF INDIO.

IF YOU KNOW WHERE THE PARCEL LAND IS, THERE ARE TWO TRAILER PARKS, THERE'S A SCHOOL, THERE'S A SENIOR LIVING COMMUNITY.

YOU HAVE A LOT OF VULNERABLE POPULATIONS IN THIS PARTICULAR AREA OF INDIO.

BY LAST ASK TONIGHT IS OVER THE COMMISSION.

I AM REQUESTING YOU ASKED STAFF TO PUT A HALT TO BIDDING, APPROVING, ENTERTAINING ANY FUTURE GAS STATIONS IN THE CITY OF INDIO.

WE ARE OKAY WITH THE ADDED GAS STATION LESS THAN A MILE AWAY FROM ANOTHER GAS STATION.

WE ARE OKAY WITH THE EIGHT DIFFERENT GAS STATIONS ALONG MILES AVENUE.

I DO CONNECT WITH MY CONSTITUENTS BUT ESPECIALLY WHEN IT COMES TO A DECISION LIKE THIS.

AND I JUST FEEL LIKE THERE'S DEMAND FOR THESE TYPES OF SERVICES.

I TOTALLY AGREE WITH YOUR COMMENTS, RIGHT, ABOUT AGREEING TO EXPLORE, BUT I ALSO THINK WE ARE PASSING OUR HOUSING ELEMENT FOR ONE.

BUT TO EMPOWER STAFF WITH RESOURCES TO GO AND ATTRACT THE STEPS THE DEVELOPMENT.

THAT AREA IS GROWING VERY THERE HAS BEEN NEW CONSTRUCTION HAS BEEN BUILT DOWN THE STREET FROM THEIR TALAVERA IS GETTING READY TO ADD NEW CONSTRUCTION.

THERE IS PARADISO WHO ADDED ADDITIONAL NEW CONSTRUCTION THERE, LENORE ADDED NEW CONSTRUCTION THEIR COMMAND OF MONEY ADDED ADDITIONAL RESIDENTS TO THE AREA.

THAT SPECIFIC AREA IS AN AREA THAT DOES NEED A CONVENIENCE STORE AND NEED SOMEWHERE TO GO GRAB A BITE TO EAT AND A PLACE TO PUMP GAS.

NOW, I'M HOPING THIS WILL BRING OTHER PROJECTS TO THAT LOCATION.

THAT THIS WILL BRING US THE MARKET FINALLY WILL COME TO LIGHT THE READING MENTIONED IT WAS APPROVED SINCE 2005.

BUT THERE HASN'T BEEN ANYONE ELSE WHO PRESENTED ANY PROJECTS OR ANYTHING FOR THAT SPECIFIC LOCATION.

AND I THINK IF WE WERE TO PUT, WOULD RATHER SEE A GAS STATION THERE GRITTED IS NOT A GOOD LOCATION FOR HOMES.
